Terms of Service

Plain-language summary: Help a Human is a crowdfunding platform (like GoFundMe). It is not a gifting program, investment, lottery, or money-making opportunity. Donations are voluntary and non-refundable, and there is no promise that any campaign will raise money or that you'll get anything back.

These Terms of Service ("Terms") govern your access to and use of Help a Human (the "Platform"), operated by Help a Human ("we", "us", "our"). By creating an account, starting a campaign, donating, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. What Help a Human is — and is not

Help a Human is an online crowdfunding service that lets individuals ("Recipients") create pages ("Campaigns") to request voluntary financial support and other help from others ("Donors" or "Supporters"). We provide the technology and hosting; we are not a party to any donation, agreement, or relationship between Recipients and Donors.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Platform. You agree to provide accurate, current information and to keep it updated.

3. Your account

You are responsible for your account, your password, and all activity under it. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or our Acceptable Use Policy.

4. Starting a campaign

As a Recipient, you are solely responsible for your Campaign, including your story, the accuracy of all statements, your stated needs, and the use of any funds you receive. You agree to:

We may review, decline, pause, or remove any Campaign at our discretion, including Campaigns that violate these Terms or that we believe are fraudulent, misleading, or harmful.

5. Launching a campaign: community donation & platform fees

To keep the community made up of genuine participants, before a new Campaign goes live we may require the Recipient to:

These are not gifts to us in exchange for the ability to receive gifts, and they are not pooled or redistributed to other members. The community donation goes to the introducing Recipient's Campaign; the service fee is paid to the Platform for services. After a Campaign has raised $500.00, ongoing access is provided for a recurring service fee of $25.00/month or $250.00/year; below that amount, no recurring fee applies. We never take a percentage of the donations a Recipient receives. Full details and current amounts are in our Refunds & Fees Policy.

6. Donations

All donations are voluntary and non-refundable except as described in our Refunds & Fees Policy or as required by law. Donors should only give what they can afford to give away. We do not provide tax, legal, or financial advice; donations to individuals are generally not tax-deductible. We are not responsible for how a Recipient uses funds.

7. "Gift", "loan", and "pay-it-forward" labels

Donors may label a contribution as a gift, a loan, or a pay-it-forward contribution. These labels are informational only to set expectations between a Donor and Recipient. We do not enforce, collect, guarantee, or mediate any "loan" repayment, and any "loan" label does not create a legally binding loan administered by us.

8. Payments

Card payments are processed by third-party providers (such as Stripe), subject to their terms. Recipients may also list their own payment methods (e.g., Cash App, Venmo, Zelle, PayPal) and confirm receipt manually; those transactions occur off-Platform and are solely between the Donor and Recipient. We are not responsible for off-Platform payments.

9. Prohibited conduct

You agree not to misuse the Platform. Prohibited activities are described in our Acceptable Use Policy, which is part of these Terms.

10. Your content

You retain ownership of the content you post. You grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute your content for the purpose of operating and promoting the Platform and your Campaign. You are responsible for having the rights to everything you post.

11. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that Campaigns are accurate, that Recipients will use funds as described, or that the Platform will be uninterrupted or error-free. You use the Platform at your own risk.

12. Limitation of liability

To the fullest extent permitted by law, Help a Human and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of funds, donations, or data, arising from your use of the Platform or from any Campaign or donation. Our total liability for any claim relating to the Platform will not exceed the total service fees you paid to us in the 12 months before the claim.

13. Indemnification

You agree to indemnify and hold harmless Help a Human from any claims, damages, or expenses arising out of your Campaign, your content, your use of the Platform, or your violation of these Terms.

14. Termination

You may stop using the Platform at any time. We may suspend or terminate your access at any time, with or without notice, for any violation of these Terms or to protect the community.

15. Changes

We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date; continued use after changes means you accept them.

16. Governing law & disputes

These Terms are governed by the laws of the state in which the operator is established, without regard to conflict-of-law rules. You agree to resolve disputes in the courts located there, unless applicable law requires otherwise.
